Impugned in this appeal filed by UT of J&K is an order dated 02.03.2023, passed by the Court of Learned Special Judge [Designated Court under NIA Act] Baramulla [“the Trial Court”] in case FIR No. 27/2021 of P/S Kheeri titled “UT of J&K Vs Waseem Ahmad Mir & Anr.”, whereby the Trial Court has granted bail in favour of respondent-Bashir Ahmad Bhat. This appeal is pending consideration since April 2024. 02. Mr. Moshin Qadri, learned Sr. AAG, very fairly submitted that out of total 16 prosecution witnesses, 15 witnesses have been examined. He further submits that at the time the bail was granted, only 8 witnesses have been examined. 03. In view of the fact that only one prosecution witness remains to be examined and the trial has reached its final stage, we do not wish to interfere with the impugned order of grant of bail to the respondent, more particularly when it has not been demonstrated before us that the respondent, after having been enlarged on bail, has violated any terms and conditions of the bail or has interfered with the trial in any manner. 04. For all these reasons, we do not find a good reason to interfere with the order impugned and, accordingly, the appeal is dismissed.
