Heard learned counsel for the parties and perused the record. 3. The appellant had filed the claim petition bearing File No. 408/C titled “Paramjeet Singh vs. Go Digital Insurance Ltd.”, which was clubbed with other claim petitions and in terms of order dated 13.12.2023 passed by the learned MACT, Jammu, (for short the ‘Tribunal’) the claim petition filed by the appellant was dismissed on the ground of limitation. 4. This Court in MA No. 44/2023 has considered the identical controversy and by placing reliance upon the order passed by the Hon’ble Supreme Court of India in case titled as ICICI Lombard General Insurance Co. Ltd. v. Ayiti Navaneetha and others, had allowed the appeal and remitted the matter to the learned Tribunal for its disposal in accordance with law. It was further observed that any Serial No. 157 2 Mac App No. 22/2024 order passed by the learned Tribunal shall remain subject to outcome of the decision in SLP(s). 5. In view of the above, order dated 13.12.2023 is set-aside and the matter is remitted to the learned Tribunal for its disposal in accordance with law, however, any final order passed by the learned Tribunal shall remain subject to outcome of decision in SLP(s) pending before the Hon’ble Supreme Court of India. 6.
