The petitioners, through the medium of the instant petition preferred under Section 482 Cr.P.C., seek quashment of impugned FIR No. 0051 dated 16.05.2024, registered at Police Station Ramnagar, District Udhampur, for commission of offences under Sections 458, 323, 147, 504 and 506 IPC. Record reveals that, vide order dated 29.05.2024, this Court permitted the investigating agency to proceed with the investigation of the impugned FIR. However, it was directed that the filing of the challan shall await further orders of this Court.
Learned counsel for respondent No. 1submits that the investigation has since been concluded and the offences alleged against the accused/petitioners have been proved. He, therefore, seeks permission to file the challan before the competent Court, submitting that the same could not be filed earlier in view of the rider imposed by this Court. Confronted with the aforesaid submission, learned counsel for the petitioners seeks withdrawal of the instant petition with liberty to contest the proceedings before the competent Court upon filing of the challan. In view of the aforesaid statement, the instant petition is disposed of with a direction to the respondents to file the challan before the competent Court in accordance with law. Upon filing of the challan, the petitioners shall be at liberty to raise all available grounds, both factual and legal, before the competent Court. The learned trial Court shall consider and proceed with the matter strictly in accordance with law. The petition stands disposed of in the aforesaid terms. Interim direction, if any, shall stand vacated.
