CMP (M) Nos.370 & 371 of 2026 The present application under Order 22, Rule 4 read with Section 151 of CPC and Section 5 of the Limitation Act have been filed to bring on record the legal heirs of deceased respondent No.3-Roop Lal, after condonation of delay and setting aside the abatement. 2. As per the applicants/appellants, respondent No.3 had expired on 09.04.2024 and left behind his legal representatives, as mentioned in para-2 of the application [CMP(M) No.370 of 2026), who are required to be brought on record. The applications are duly supported by the affidavits of Hem Dutt Sharma, Dy. Divisional Manager (Legal) of the applicants/appellants, as well as legal heirs certificate and death certificate, Annexures A-I & A-II, respectively. 3. Heard. Keeping in view the facts and circumstances of the case, the present applications are allowed and the legal heirs of deceased respondent No.3 Roop Lal, as mentioned in para-2 of the application {CMP(M) No.370 of 2026}, are ordered to be brought on record, after setting aside the abatement, if any. 4. The applications stand disposed of. CMP(M) No.1207 of 2024 5. No reply(ies) is/are intended to be filed to the application. 6. Heard. Having regard to the averments made in the application, which is duly supported with affidavit of applicant No.1, the same is allowed and the delay of 169 days’ in filing the appeal, which in my considered view has sufficiently been explained, is hereby condoned. 7.
