Petitioner has filed this writ petition seeking following reliefs: 10.1 This Hon'ble Court may kindly be pleased to direct the respondent authority to take decision upon the application of the petitioner dated 25.04.2023 pending before the respondent no. 1 in light of the judgment of Hon'ble Supreme Court passed in 2008(1) SCC 579. 10.2 This Hon'ble Court may kindly be pleased to direct the respondent authority to extend the benefit of the disability to the petitioner as per guideline issued by the Hon'ble Supreme Court in 2008 (1) SCC 579. 10.3 This Hon'ble Court may kindly be pleased to direct the respondent authority to extend the benefit of Section 20 of Right of Persons with Disability Act, 2016 to the petitioner. 10.4 This Hon'ble Court may kindly be pleased to grant any other relief(s)/ writ(s), order(s) in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts & circumstances of the case, including awarding of the costs to the petitioners.

Learned counsel for the petitioner submits that petitioner while working on the post of Upper Division Teacher has suffered permanent
3 / 3 disability and is unable to perform his work as Teacher. Pursuant to Circular issued by the State Govt. of the year 2005 petitioner has submitted an application for grant of salary till petitioner attains age of retirement. Said application was forwarded by Block Education Officer to District Education Officer and further District Education Officer forwarded the same to the Director i.e. respondent No.2 which is pending consideration and therefore a direction be issued to respondent No.2 to consider and take decision on claim of petitioner at the earliest within specified time frame.

Learned counsel for the State submits that from perusal of documents, it is appearing that on the application made by petitioner his claim is processed, however, from Annexure P-4 it is appearing that it is forwarded to respondent No.2. He submits that if the claim of petitioner is still pending consideration it would be considered in accordance with law.

On due consideration of submission of learned counsel for the parties, nature of grievance raised and further that claim of petitioner is processed through proper channel and is pending consideration at the end of respondent No.2, this writ petition at this stage is disposed of directing respondent No.2 and 4 to consider and take decision on the claim of petitioner in accordance with law, expeditiously, preferably within a period of 4 months from the date of receipt of copy of this
