JUDGMENT
1. The petitioners by way of the present clubbed writ petitions filed under Article 226 of the Constitution of India, have assailed Advertisement Notification No. 03 of 2024/RG/GS dated 05.06.2024 issued by the High Court of Jammu & Kashmir and Ladakh (Office of the Registrar General). In addition, thereto, in WP(C) No. 1805/2024, the petitioners have also called in question Order No.1176 of 2024/RG dated
31.07.2024.
2 W.P.(C) 1805/2024 c/w WP(C) 1522/2024
2. This Court vide order dated 10.04.2026 had granted permission to the petitioners to file a fresh representation before the Registrar General of this Court within a period of one week and upon filing of such representation, the same was directed to be accorded due consideration expeditiously, preferably within a period of three weeks thereafter. The Court further directed that the decision so taken shall be placed on record on the next date of hearing.
3. When the matter was taken up, the learned counsel appearing for the respondents placed on record notification bearing S.O 173 dated 16th June 2026 issued by the Department of Law, Justice and Parliamentary Affairs in exercise of the powers conferred by proviso to article 309 read with article 233 of the Constitution of India, whereby certain amendments were made to the Jammu and Kashmir Higher Judicial Service Rules 2009. A copy of the notification is taken on record.
4. Thus, with the issuance of the aforesaid notification, the grievance of the petitioners projected in both the petitions no longer survive for adjudication and the relief sought by the petitioners has become infructuous.
5. In the light of the aforesaid development, both the writ petitions i.e. WP(C) No.1805/2024 & WP(C) No.1522/2024 have rendered infructuous and the same are dismissed along with all connected applications. However, dismissal of the writ petitions shall not come in the way of the petitioners to agitate their cause afresh, if fresh cause of action accrues.
6. Accordingly, the aforementioned writ petitions i.e. WP(C) No.1805/2024 & WP(C) No.1522/2024 along with all connected application(s), if any, shall stand dismissed as having been rendered infructuous.
