Learned Senior counsel appearing for the respondents/plaintiffs submits that though the respondents are not entitled to any relief but in the interest of justice, one more opportunity is granted to the petitioners to appear before the learned trial Court for recording of their statements under Order 10 Rule 1 CPC subject to costs and he further submits that in the event, the petitioners do not appear before the learned trial Court for recording of their statements in terms of Order 10 Rule 1 CPC, the order dated 04.07.2024 may be allowed to stand. 2. Learned counsel for the petitioners submits that the petitioners would cause their appearance before the learned trial Court on the date so fixed by the learned trial Court for recording of their statements in the event, this Court grants one opportunity to the petitioners. 3. In view of the above, order dated 04.07.2024 is set aside subject to payment of costs of Rs. 6,000/- to the respondents and it is further directed that in the event, the petitioner(s) is/are do/does not cause appearance before the learned trial Court for recording of his/her/their Serial No. 27 2 CM(M) No. 218/2024 statement(s) on the date so fixed by the learned trial Court, the consequences as envisaged in order dated 04.07.2024 shall follow. 4. The petitioners shall produce the copy of this order before the learned trial Court. On receipt thereof, learned trial Court shall fixed date for recording of the statements of the petitioner(s).
