The controversy involved in the present petition wherein order dated 10.10.2024 has been assailed by the petitioner is identical to the one involved in MA No. 44/2023. Vide order dated 15.07.2026 passed in MA No. 44/2023, the order impugned therein, whereby the claim petition preferred by the petitioner therein was dismissed by the learned Tribunal on account of being time barred, was set aside and the matter was remitted to learned Tribunal for its disposal in accordance with law. It was further directed that the any order passed by the learned Tribunal shall remain subject to outcome of the decisions in the SLP. 2. Accordingly, this petition is allowed and order dated 10.10.2024 is set aside and the matter is remitted to the learned Presiding Officer, MACT Poonch for its disposal in accordance with law. However, it is made Serial No. 136 2 CM(M) No. 270/2024 clear that any order passed by the learned Tribunal shall remain subject to outcome of the decisions in SLP. 3. Disposed of.
