Perused the case record, order sheets and disposed of order dated 02.09.2022 passed in W.P.(C)(OAC) No.2068 of 2017. Learned A.S.C. submitted that O.P. No.5 has filed show cause affidavit on 10.10.2025 which is available in the case record. Perused this affidavit. The relevant portions are as follows:- “That the said W.A. No.1036 of 2022 disposed Vide judgement dated 02.07.2024. In which the Hon’ble Page 2 of 2. Division Bench pleased to set-aside the judgment & order dated 16.11.2021 of the Hon’ble Single Judge passed in WPC(OAC) No.2766 of 2015 (Saroj Kumar Dash-Vrs-State of Odisha & Others). In such view of the matter, the Execution Proceeding is not sustainable. Copy of Judgment dated 02.07.2024 passed in W.A. No.1036 of 2022 is annexed herewith as Annexure-A/5.” In view of the disposal of W.A.No.1036 of 2022 in which the order passed in WP(C) (OAC) No.2766 of 2015 was set aside, this execution petition is dropped.
