The subject matter of this appeal is substantially similar to the one in Writ Appeal No. 17 of 2023 between State of Odisha & Ors. Vs. Krushna Chandra Mallick & Anr. heard and disposed off by this Court vide order dated 15.07.2025 whereby impugned order of the kind has already been upheld by us. We also note that there is a long delay of 447 days brooked in filing the appeal. 2. An application in I.A. No.2751 of 2024 supported by affidavit seeking its condonation has been moved. Delay is too long and in our considered view, the explanation offered is not plausible. 3. In the above circumstances, this Appeal is dismissed both on merits and on delay in terms of Krushna Chandra Mallick (supra). Appellants to implement order of the Single Judge within an outer limit of eight (08) weeks. Registry has to send a copy of this order to the Respondents.
