Heard learned counsel for the Appellant and perused the record. 4. As per office report dated 24.08.2024, notice has been duly served upon Respondent No. 2 personally. Despite service, none has appeared on behalf of Respondent No. 2, nor have any objections been filed. 5. The present Special Leave to Appeal has been preferred on behalf of the Appellant seeking leave to appeal against the impugned judgment and order dated 26.03.2024, passed by the learned Civil Judge II/Judicial Magistrate, Roorkee, District Haridwar in Criminal Complaint No. 1716 of 2021, “Touqeer Alam vs. Kamil”, under Section 138 of the Negotiable Instruments Act, 1881, pertaining to Police Station Kotwali Gangnehar, District Haridwar, whereby the learned trial Court has acquitted the accused– Respondent No. 2 of the charges levelled against him. 6. Upon consideration of the submissions advanced by learned counsel for the Appellant and upon perusal of the impugned judgment, this Court is of the view that, at this stage, sufficient grounds exist for grant of leave. Accordingly, the Special Leave to Appeal is granted. 7. Trial Court Record has been received. 8. The Registry is directed to prepare the paper book and furnish copies thereof to learned counsel for the parties in accordance with the Rules. 9. Objections, if any, be filed by the Respondents. 10.
