Respondent No.4 already ex parte. CMP No.13262 of 2026 The present application under Section 151 CPC has been filed on behalf of applicant/respondent No.1, Sher Singh, for release of the compensation amount lying deposited in the Registry of this Court alongwith up-to-date interest. As per the applicant/respondent No.1, he needs money to meet out his day to day expenses including food clothing etc. The application is duly supported by an affidavit of the applicant. No reply is intended to be filed to the application. However, learned counsel for the non- applicant/appellant has opposed the application on the ground that in the event of appeal being allowed, it would be difficult for the non-applicant/appellant to recover the amount, so released. Heard. Having regard to the averments made in the application, which is duly supported by an affidavit of the applicant, this Court finds it in the interest of justice to release 30% of the compensation amount, in favour of applicant/respondent No.1, Sher Singh, as per his share, lying deposited in the Registry of this Court, alongwith up-to-date interest by remitting the same to his bank account, after proper verification and identification, details whereof have been mentioned in para-4 of the application. Ordered accordingly. However, release of amount would be subject to final outcome of the appeal and in the event of appeal being allowed, the applicant/respondent No.1 will have to refund the amount, so released, with interest.
