Delay Condonation Application (IA No. 2 of 2026) is allowed. Delay in filing the substitution application is hereby condoned. 5. Substitution Application, being not opposed by the other side, is allowed. 6. Legal heirs of respondent no. 2 are allowed to be substituted as respondent no. 2/1. 7. Learned counsel for the applicant as well as learned counsel for newly substituted respondent submitted that the matter has been amicably settled between the parties and the respondent no. 2 has deposited the entire cheque amount by way of demand draft. 8. On this basis, they have submitted that they would be filing a compounding application before the Magistrate concerned and the Magistrate concerned be directed to consider the same. 9. The prayer sought by learned counsel for the parties is innocuous. 10. Accordingly, the present criminal misc. application is disposed of with a liberty to the parties to file their compounding application before the court concerned and the Magistrate concerned shall consider and decide the same within a stipulated timeframe, as per law.
