Ajay Mohan Goel, Judge (Oral) Mr. Nitin Thakur, Advocate, learned counsel for respondent No.3 submits that the reply on behalf of said respondent is on record. He has made available a copy of the reply for the perusal of the Court. A perusal of the reply filed by respondent No.3 demonstrates that the stand of the respondent No.3 is that the said University prepares the academic calendar, which also includes the examination schedule. It is further averred in the reply that the sanction, regulation and scheduling of earned leave including grant 2 of leave on rotational basis or otherwise falls within the administrative discretion and authority of the Head of the Institution in accordance with the applicable service Rules and Institutional requirements. According to respondent No.3, said University has no role in such matters and, therefore, it cannot be held responsible for any grievance relating thereto. 2. Faced with this situation and in the light of the fact that the concerned Institutions are not before this Court, except one, learned counsel for the petitioner prays for and is allowed to withdraw the instant petition, with liberty to the petitioner to approach the Court afresh on the same cause by impleading the aggrieved persons as petitioners, as also by impleading the Institutions concerned as respondents. 3 Pending miscellaneous applications, if any, also stand disposed of.
