H. RAJESH PRASHAD AND ORS. (POWER DEVELOPMENT CORPORATION)
...Respondent(s) Through: Mr. Shahbaz Sikander, AAG
CORAM:
HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE
O R D E R 13-07-2026
1. Through the medium of present petition, the petitioners are seeking implementation of order dated 22.05.2023 passed by the writ court, whereby respondents were directed to consider the case of the petitioners for promotion within a period of six months.
2. The respondents have filed compliance report. Along with the compliance report, they have placed on record a copy of the consideration
order bearing number 219-JK(PDC) of 2025 dated 01.09.2025. As per the said consideration order, the case of the petitioners for according promotion to them was considered, and it was found that their claim to promotion amounts to change of cadre from Helper (Non-Technical) to Crane Operator, (Technical), which is not permissible under the rules. Hence, their claim has been rejected.
3. In view of the above, the order of the writ court stands complied with. The contempt proceedings are therefore closed, leaving it open to the
petitioners to lay challenge to the consideration order, if so advised, by way of appropriate proceedings.
4. Contempt petition stands disposed of.
