By the present MC (RSA) No.19 of 2023, the applicant/appellant prays for impleading one Lisham (O) Bhanumati Devi, proforma respondent in RSA No.6 of 2024. It is submitted that proposed respondent No.2 was defendant No.5 before the Trial Court and also respondent No.5 before the First Appellate Court. Inadvertently, while filing application for condonation of delay and Second Appeal, name of proposed respondent No.2 could not be included in the memo of parties. It is submitted that respondent No.2 is necessary party in deciding the accompanying RSA. Mr.M.Rarry, learned senior counsel for respondent No.1 submits that main RSA would be defective without making proposed respondent No.2 as party and he has objection. This Court has considered the materials on record and proposed respondent No.2 is defendant No.5 in the Original Suit before the Trial Court and respondent No.5 in the First Appeal before the learned District Judge, as such, she is a necessary party in the Second Appeal filed by the appellant/defendant Nos.1 to 4. Accordingly, MC (RSA) No.19 of 2023 is allowed. Lisham (O) Bhanumati Devi, aged about 79 years, w/o (late) L.Hetachandra Singh R/O Wangkhei Thambalkhong, Lisham Leirak, PO & PS Porompat, Imphal East District, Manipur, is impleaded as respondent No.2 in the accompanying RSA No.6 of 2024. Misc case is disposed of. Registry is directed to make necessary incorporation in the main Paper Book. Appellants are directed to file amended memo of parties on line with the physical copy. List the remaining matters on 3.6.2026 for admission. Issue Notice to the newly impleaded respondent No.2 by speed post and dasti, in addition within one week and file proof of affidavit for service.
