As per report received from learned Additional Chief Judicial Magistrate, Shimla, the non bailable warrants of arrest issued to the accused could not be executed as his whereabouts are not known. The applicant has filed the present application for condonation of delay in filing the revision. It has been asserted that the applicant was with his old mother and he was taking care of her. He could not file the revision because of this fact and there is delay of 349 days in filing the revision. Hence, the application. The applicant has not filed any document to show that his mother was ill or was suffering from locomotor disability as stated in para 2 of the application. Therefore, the applicant has not established the plea taken by him by any documentary proof. He is not appearing before this Court as well. Hence, in these circumstances, the application is dismissed. Application stands disposed of.
