The said notice was based upon a notification No. 168 dated 13.01.2022 issued by the Ministry of Environment, Forest and Climate Change (respondent No.1) under Section 3 of the Environment (Protection) Act, 1986 read with rules framed thereunder, 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 in terms of which, specified area around the boundary of Col. Sher Jung National Park in Sirmour District was notified as Eco-sensitive zone. Accordingly, petitioner was directed to discontinue the operation of its stone crusher and mining lease on the land falling within the ambit of notification. Learned Senior Counsel further submits that in Gram Panchayat Bhatanwali & others versus Union of India and others2, the notification dated 13.01.2022 has been quashed and set-aside, therefore, notice impugned in the instant writ petition dated 16.09.2024 that was in turn based upon notification dated 13.01.2022 has also lost its relevance. 2. Learned counsel appearing for the respondents acknowledged the above submissions in law and facts. 3. In view of above, this writ petition is disposed of as having been rendered infructuous.
