2. Mr. Sushil Vashisth, learned Standing Counsel for the State.
3. Petitioners are serving as Junior Engineer in State Public Works Department. They have raised a seniority dispute in this writ petition. As according to them, their seniority was wrongly determined in the final seniority list dated 04.10.2023.
4. Learned State Counsel submits that seniority dispute by Public Servants can be raised before the Tribunal established under U.P. Public Service Tribunals Act, 1976. He further submits that since petitioners have a statutory remedy, therefore, writ petition is liable to be dismissed on the ground of alternate remedy.
5. Learned counsel for the petitioner does not dispute the submission made by learned State Counsel. He, however, submits that there is some seniority dispute going on before Tribunal in Claim Petition No.138 of 2022.
6. Since similar matters are pending consideration before the Tribunal, therefore, it is all the more reason for the petitioners to approach the Tribunal.
7. The writ petition is accordingly dismissed on the ground of alternate remedy with liberty to the petitioners to approach Tribunal.
