4. Despite objections raised by the other side regarding the delay, this Court finds that the delay has been satisfactorily explained. Accordingly, the delay is condoned and the Delay Condonation Application is allowed.
5. The present Special Leave to Appeal has been filed on behalf of the State under Section 419(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, with a prayer to grant leave to government appeal against the judgment and order dated 19.06.2024, passed in Sessions Trial No. 11 of 2022, whereby the learned Special Judge (POCSO), Almora, acquitted the Respondent.
6. At this stage, learned counsel for the Respondent raises a preliminary objection, submitting that no sufficient grounds exist for grant of leave to appeal.
7. Learned State Counsel appearing on behalf of the Appellant/State, however, contends that the acquittal has been recorded on minor grounds, which could have been appropriately appreciated by the trial court, and that the matter warrants
consideration in appeal.
8. Considering the submissions advanced by learned counsel for the parties, this Court is of the view that the matter requires
consideration. Accordingly, Special Leave to Appeal is granted.
9. Summon the Trial Court Record (TCR).
10. Upon receipt of the TCR, the Registry is directed to prepare the paper book and supply the same to learned counsel for the parties, as per Rules.
11. Objections, if any, be filed by the Respondent.
12. List this case on 06.05.2026.
