4. The present Criminal Misc. Application under Section 528 of BNSS has been filed by the applicant challenging the cognizance/summoning order dated 21.03.2023 passed by learned 2nd Additional Civil Judge/Judicial Magistrate, Haldwani, District Nainital in Criminal Complaint Case No. 1335 of 2023, State Vs. Pankaj Pathak, under Sections 498-A, 323, 504 and 506 of IPC, pending in the Court of 2nd Additional Civil Judge/Judicial Magistrate, Haldwani, District Nainital.
5. In the present case, parties were sent for mediation and a compromise was reached between the parties. In the Mediation itself, it was agreed that the parties would withdraw all the pending cases filed against each other. Thereafter, the parties preferred a joint petition under Section 27 of Uniform Civil Code of Uttarakhand Act, 2024. The petition was allowed on 17.05.2025 and mutual divorce was granted to the parties. Since, parties have been granted mutual divorce and
they have settled their dispute, and as such, they are living separately, therefore, no fruitful purpose would be served if the proceedings of the case are allowed to continue against the applicant.
6. Accordingly, the present criminal misc. application is allowed. As a result, the entire proceedings of Criminal Complaint Case No. 1335 of 2023, State Vs. Pankaj Pathak, under Sections 498-A, 323, 504 and 506 of IPC, pending in the Court of 2nd Additional Civil Judge/Judicial Magistrate, Haldwani, District Nainital is hereby quashed qua the applicant. FIR and charge-sheet filed pursuant thereto also stand quashed.
