Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties. 3. Petitioner has filed the present writ petition inter alia with the following prayer:- “It is therefore prayed that this Hon'ble Court may graciously be pleased to admit this writ application, issue notice to the opp. parties and on hearing issue writ of mandamus directing the opp. parties to give the pensionary benefits under the Orissa Civil Service (Pension) Rules, 1992 and Orissa Civil Services (Pension) Amendment Rules, 2015, on the basis of covered matter which were reported in (1) 2022 (1) OLR-266 (WP(OAC) No. 864 of 2018 filed by Bandhua Gochhayat -vrs-State of Orissa & Others), (2) 2023 (Supp. I) OLR 602 (W.P.(C) No. 36009 of 2021 filed by Rabindra Kumar Jena -vrs- State of Orissa & Others) and (3) 2022 (III) ILR CUT 282 (W.P.(C) 1791 of 2017 filed by Debendranath Sahoo -vrs- State of Orissa & Others), Page 282, for the interest of justice. Page 2 of 2. And pass any other order/orders would be deem fit and proper as facts and circumstances of the case. And for the said act of kindness, the petitioner shall as in duty bound ever pray.” 4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence. 5. It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 2 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation.
