Cr.MP No. 2115 of 2026 Present application has been filed for issuing directions to the Superintendent of Police, Shimla to produce the proclaimed offender before the Court of law. It has been asserted that the applicant had submitted a request to the Superintendent of Police, Shimla to take action as per the decision dated 9.7.2024, passed by the Court, however, the police have not taken any action. Hence the application. Heard. The application is misconceived to stay the leave. The provisions of Section 40 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS) confers the power upon a private to arrest the proclaimed offender. Therefore, the petitioner himself is at liberty to arrest the person and produce him before the competent authority. Further the police is also duty bound to arrest a proclaimed offender and the direction is not required to be issued for the aforesaid purpose. Hence the application is dismissed.
