State of Odisha disposed off vide order dated 19.12.2011 by the Co-ordinate Bench. We are not shown that this order of the Co-ordinate Bench was put in successful challenge. Learned Single Judge has structured the impugned order keeping in view the said decision. In the above circumstances, this Appeal being devoid of merits is liable to be rejected and accordingly it is, both on merits and on delay of 397, for which there is no plausible explanation. Order of the learned Single Judge shall be given effect to within an outer limit of eight (8) weeks. Registry to send a copy of this order to the sole Respondent by speed post immediately.
