HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CRM(M) 743/2024 CrlM(1708/2024) CrlM(228/2025). MOHAMMAD AKBAR LONE. …Petitioner(s) Through: None. VERSUS SHAZIA MAJEED AND ANR. …Respondent(s) Through: Mr. Hakeem Aman Ali, Dy AG. CORAM: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL , JUDGE. ORDER 12.05.2026 01. Record reveals that no one has appeared on behalf of petitioner on 16.07.2025, 22.07.2025 and also the position remained the same on 30.08.2025. The record reveals that when the matter was listed before this Court on 05.12.2025, learned counsel for the petitioner has submitted that he was under an impression that the petitioner had paid the amount and accordingly sought time to enquire about the same from the petitioner, whereupon the matter was directed to be listed thereafter. 02. Today again, when the matter was taken up, there is no representation on behalf of the petitioner, nor has the petitioner conveyed to this Court whether the amount has been paid, as was already observed by this Court vide order dated 05.12.2025. Thus, an inference can be drawn that the petitioner is not interested in prosecuting the instant matter. 12 Regular 03. Accordingly, the petition which has been preferred under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS) is dismissed for non-prosecution. 04. Interim direction(s), if any, subsisting as on date shall stand vacated. (WASIM SADIQ NARGAL ) JUDGE SRINAGAR 12.05.2026 Bisma Jan.
