JUSTICE R.K. PATTANAIK Order No. ORDER 10.03.2026 02. 1. Both the ABLAPLs are taken up together and disposed of by the following common order. 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with 1C.C. Case No.159 of 2023 pending in the court of learned J.M.F.C., Basta on the grounds stated therein. 3. Perused the complaint as at Annexure-1 and also the FIR i.e. Annexure-2 lodged from the side of the petitioners. Mr. Panda, learned counsel for the petitioner in ABLAPL No.8204 of 2024 submits that the learned court below has taken cognizance of offence under Section 395 I.P.C. against all the accused persons, which is filed as a counterblast to the FIR i.e. Annexure-2. Similar submission is made by Mr. Mohanty, learned counsel for the co-accused persons in ABLAPL No.8407 of 2024 with reference to the FIR at Annexure-4 therein. Recorded the objection of the State. On the basis of the complaint filed against the petitioners, the learned court below has taken cognizance of the alleged offence. The allegation in the complaint is that the petitioners snatched away cash of Rs.20,000/- from the complainant. The parties are known to each other and the reason behind the alleged incident has been described in the complaint registered as 1.C.C. No.159 of 2023, wherein, NBWAs have been issued and pending execution against the petitioners. Considering the above facts and since the petitioners have been implicated in a complaint case, wherein, they are apprehending arrest in view of the NBWAs issued awaiting execution, this Court recording the objection of the State is inclined to direct them to surrender before the learned court below for being released with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petitions stand disposed of with a direction to the petitioners to surrender before learned J.M.F.C., Basta within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with 1C.C. Case No.159 of 2023 on furnishing bail bonds of Rs.25,000/- (rupees twenty-five thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6.
