IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.26622 of 2024 Sumita Naik and Ors. …. Petitioners Ms. S. Patnaik, Advocate -versus- State of Odisha and Others …. Opposite Parties Mr. P.K. Panda, ASC Mr. M. Pati, Advocate for Intervenor Mr. A.K. Chhatoi, Advocate for Intervenor CORAM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No. ORDER 09.03.2026 10. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel for the parties. 3. It is fairly contended by learned counsel for the petitioners that after issuance of the Draft Gradation List of Forest Guard of Rourkela Circle as on 30.06.2021 vide letter dated 20.09.2021, no objection was filed challenging the position of the petitioners vis-à-vis the private Opp. Parties. 4. Since no objection was filed as admitted by the learned counsel for the petitioners, it is the view of this Court that petitioners are not eligible and entitled to challenge their position in the final Gradation List, which is impugned in the Writ Petition. Accordingly, the writ petition with the challenge made is not maintainable and stands dismissed. 5. The Writ Petition stands dismissed. 6. Interim order passed earlier stands vacated.
