Captioned miscellaneous case (MC) has been filed with a condonation of delay (CoD) prayer qua 30 (thirty) days delay in filing an intra-court State appeal i.e., Writ Appeal (WA). [2]
Mr. BR Sharma, learned CGSC (Central Government Standing Counsel) for appellants/applicants, adverting to paragraphs A to K being paragraphs preceding main paragraph No. 5, submits that various stages of the delay sought to be condoned have been explained and the explanation would demonstrate that time consumed in taking decision in filing appeal and preparing the appeal has only resulted in delay and therefore the same was neither willful nor wanton. [3]
Ms. N. Jyotsana, learned counsel for all the 76 respondents opposes the CoD prayer by saying that paragraphs A to K preceding main paragraph 5 of the CoD petition adverted to by learned State Counsel is only a case of what is being repeatedly described by Courts as ‘file pushing’. This Court carefully considered all aspects of the matter. Considering the facts and circumstances of the case, the nature of the matter, the issues involved and also taking into account the manner in which the parties are circumstanced, this Court deems it appropriate to accede to the CoD prayer. [5]
Consequently, delay condoned. [6]
Registry to process the Writ Appeal, assign a number and list it on Board if otherwise in order.
