Jyotsna Rewal Dua, Judge Following order was passed in the matter on 06.01.2026:- “Learned Deputy Advocate General has placed on record copy of office instructions dated 06.01.2026. Instructions noticed the clear factual position that regular service rendered by the petitioner was eight years eight months and twenty three days and daily wages service rendered by him was eight years eleven months and two days. Thus total regular service to the credit of the petitioner in accordance with law laid down in Sunder Singh versus The State of Himachal Pradesh & others, Civil Appeal No.6309/2017, decided on 08.03.2018 as 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes - 2 - clarified in Balo Devi and others versus State of Himachal Pradesh and others, Civil Appeal No.4792/2022, decided on 18.07.2022 becomes nine years eight months and twenty three days. Despite this, respondents have still not processed the case of the petitioner for pension. From the office instructions, it appears that his file is being tossed around in different departments for obtaining their legal opinion. Let respondent no.1 to remain present in the Court on next date of hearing. List on 08.01.2026.” 2. Pursuant to above, Learned Assistant Advocate General has placed on record office instructions dated 08.01.2026 from the Labour Commissioner-cum-Director of Employment & Overseas Placement, H.P., conveying that representation of the petitioner has been reconsidered and allowed by granting pensionary benefits to the petitioner under order dated 07.01.2026. Copy of the said order has also been appended alongwith the office instructions. 3. Learned Assistant Advocate General submits that costs imposed under the judgment shall be paid to the petitioner within two weeks from today. 4. Taking note of the above, present proceedings are closed. Notices issued to the respondents are discharged. It is hoped and expected that processing of the case of the petitioner shall be expedited by the respondents. Necessary - 3 - cooperation, if any, required from the petitioner, shall also be rendered by him to the concerned authorities. Pending miscellaneous application(s), if any, also stand disposed of.
