JUSTICE AHANTHEM BIMOL SINGH 21.01.2026 [1] Heard Mr. Kh. Tarunkumar, learned Sr. counsel assisted by Ms. Julekha Khan, learned counsel appearing for the petitioner and Mr. Th. Vashum, learned GA appearing for the respondents. [2] The present writ petition has been filed with a prayer, inter alia, for quashing and setting aside of Clause 1 and Clause 2(d) of the office memorandum dated 07.12.2017 (Annexure-A/9) and for issuing a direction to the respondents to appoint the petitioner to a suitable post commensurate with his educational qualification under the Die-in-Harness Scheme of the Government of Manipur within a stipulated period. [3] At the outset, the learned Sr. counsel appearing for the petitioner submitted that during the pendency of this writ petition, Lucy Gurum ayum Digitally signed by Lucy Gurumayum Date: 2026.01.22 11:17:43 +05'30' Page 2 the impugned memorandum dated 07.12.2017 has been subsequently re-viewed and some changes has been brought in and as such, the learned Sr. counsel prays that the present writ petition can be disposed of by issuing a simple direction to the respondents to consider the case of the petitioner for his appointment under the Die-in-Harness Scheme strictly in terms of applicable rules/guidelines and seniority position of the applicants maintained by the department i.e. SCERT, Government of Manipur. [4] Mr. Th. Vashum, learned GA appearing for the respondents fairly submitted that the respondents will have no objection to consider the claim of the petitioner for his appointment under the Die-in-Harness Scheme strictly in terms of the applicable rules/guidelines and according to the seniority of the applicants maintained by the department of SCERT, Government of Manipur and that the present writ petition can be disposed of as prayed for on behalf of the petitioner. [5] Considering the submission made by the learned counsel appearing for the parties, this Court is of the considered view that it will be in the interest of justice to issue the following directions; Page 3 (i) The respondents are hereby directed to consider the claim of the petitioner for his appointment under the Die-in-Harness Scheme to a suitable post commensurate with his educational qualification strictly in terms of applicable rules/guidelines and the seniority position of the applicants maintained by the department of SCERT, Government of Manipur and to issue appropriate orders. (ii) It is made cleared that the aforesaid direction has been issued without considering the merit of the present writ petition.
