The admitted position which gets culled out from two rounds of litigation, first in terms of OWP No. 1556/2010 read with second round of writ petition- WP(C) No. 1528/2023 both filed by the petitioner, is that the petitioner’s 1 kanal 10 marlas and 1 sarsai land in khasra No. 56 min in village Kundarorian, Katra at no point of time ever formed subject matter of any acquisition proceedings to become part of the acquired land and that remains the position as on date. 2. This position of fact gets confirmed from the fact that the Katra Development Authority (KDA) by virtue of an exercise undertaken in year 2025 has reached to the District Commissioner, Reasi, asking for acquisition of the petitioner’s owned and possessed land measuring 1 kanal 10 marlas and 1 sarsai land in khasra No. Regular List Serial No. 12 2 CCP(S) No. 122/2024 in WP(C) No.1528/2023 56 min and this is what is the base position obtaining as on date and that suffices the intendment of the writ court direction as given in order dated 22.12.2023 so as to clear the petitioner’s ownership land from any tag of being land under acquisition process. 3. This contempt petition is, thus, closed without prejudice to the right of the petitioner to resort to an appropriate legal course of action including filing of writ petition before this Court in case the petitioner’s ownership and right for the land in reference are prejudiced or meant to be prejudiced at the end of the public authorities/officers/officials is adopting due course of law. 4.
