Cibi Chakraborthuy, Additional Government Pleader Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent no.1 to provide the necessary difference in monetary benefits by considering the representation of the petitioner dated 04.12.2023 within the time stipulated by this Court. ORDER This writ petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to provide the necessary difference in monetary benefits by considering the representation of the petitioner dated 04.12.2023, within the time stipulated by this Court. 2. The limited contention raised by the petitioner is that, though his retirement benefits have been settled, the monetary benefits due to him on account of the third review, which is applicable upon completion of 30 years of service, have not been paid. To that effect, he has made a representation dated 04.12.2023, which has not been considered till date. 2/6 WP(MD) NO. 1448 of 2024 3. The first respondent has filed a counter-affidavit contending that all monetary benefits due to the petitioner have already been granted, after deduction of a sum of Rs.27,300/- [Rupees Twenty- Seven Thousand and Three Hundred only] pursuant to the punishment imposed on him. It is further contended that stoppage of increment with cumulative effect for a period of 42 months was imposed as a punishment during the crucial period of consideration and, hence, the petitioner is not entitled to any further monetary benefits. 4. Be that as it may, since the petitioner has specifically raised a contention that he is entitled to the third revisionary benefit, which alone has not been paid to him, and since the representation dated 04.12.2023 specifically raises the said issue, the same requires consideration by the first respondent. 5. Therefore, the first respondent is directed to consider the petitioner's representation dated 04.12.2023 as expeditiously as possible and, in any event, within a period of two months from the date of receipt of a copy of this order. While disposing of the representation, the first 3/6 WP(MD) NO. 1448 of 2024 respondent shall also furnish the petitioner with a calculation sheet setting out the manner in which the amount, if any, payable to him has been arrived at. 6. With the above observations, this writ petition is disposed of.
