Serial No. 20 Regular List HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S) No. 46/2024 M/S. Riyaz Ahmad Qadiri …Petitioner(s) Through: Mr Usman Malik, Adv, vice Mr Aadil Asmi, Adv. Vs. UT of JK and Ors. ...Respondent(s) Through: Mr. Bikramdeep Singh, Adv. CORAM: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE. ORDER 18.04.2026 01. Mr. Bikramdeep Singh, learned Dy. AG, appearing for the respondents submits that in the Order dated 23rd March, 2026, inadvertently, it has been reflected “that respondents were required to release the balance amount of Rs. 1,33,46,000/- in favour of the petitioner along with interest” and he was directed to file compliance of Order dated 20th February, 2026. 02. The aforesaid order was passed in presence of Mr. Bikramdeep Singh, learned Dy.AG, whereby he has sought time to file compliance report, failing which, the respondents 3 and 4 were to appear in person physically or through virtual mode. 03. Learned counsel for the respondents clarifies that inadvertently the aforesaid figure has been incorporated, when in fact the respondents were required to release an amount of Rs. 13,34,600/- which is required to be rectified. 04. With a view to fortify his claim, Mr. Bikramdeep Singh, learned Dy.AG, has drawn the attention of this Court to the compliance report filed on behalf of the respondents. A perusal whereof reveals that respondents have already released an amount of Rs. 64,89,733/- and Rs. 55,21,667/- which is evident from the perusal of Communication dated 14th July, 2025 issued the F.A/Chief Accounts Officer, Srinagar Municipal Corporation addressed to the Deputy Legal Remembrancer, Srinagar Municipal Corporation. The communication further reveals that that an amount of Rs. 13,34,600/- was retained, which was required to be released after completion of DLP and after receiving requisition from Executive Engineer concerned. Mr Bikramdeep Singh, learned Dy.AG, submits that instead of an amount of Rs. 1,33,46,000/- as reflected in the Order dated 23rd March, 2026 inadvertently, an amount of Rs. 13,34,600/- was payable to the petitioner as on date. He, accordingly, prays that the same be rectified. 05. At this stage, Mr. Bikramdeep Singh, learned Dy.AG, produced a copy of the communication issued by Chief Accounts Officer, Srinagar Municipal Corporation, addressed to the Manager, J&K, Bank, Dood Ganga Road, Balgarden Srinagar, a perusal whereof reveals that even the balance amount of Rs. 17, 20, 800/- including the interest has been released, thus, nothing remains being payable to the petitioner as on date. Learned counsel submits that the whole amount along with interest stands paid, therefore, the proceedings in the instant contempt petition are required to be closed. Copy of communication produced by learned counsel for the respondents is taken on record. 06. In the light of stand taken by the respondents and in view of the aforesaid communication produced before the Court, this Court is of the considered opinion that the Order passed by the learned Writ Court, against which, the instant contempt petition was filed, stands complied with and nothing remains further to be adjudicated upon. The contempt proceedings are, accordingly, closed. 07. Rule, if any framed, shall stand discharged. (WASIM SADIQ NARGAL) JUDGE SRINAGAR: 18.04.2026 “Shamim Dar”
