ORDER This Writ Petition has been filed seeking a Writ of Mandamus, directing the 2nd and 3rd respondents not to levy or impose any tax in respect of the petitioner’s vehicle bearing Registration Nos. KA-51-AJ-4664, KA-51- AJ-4665, KA-51-AJ-4666, KA-51-AJ-4667, KA-51-AJ-4668 and KA-51- AJ-4669. 2. It is fairly submitted by the learned counsel for the petitioner that in a batch of cases in W.P.Nos.23430 of 2023 etc., batch, dated 26.09.2024, this Hon’ble Court dismissed the writ petitions following the observations made by the Hon’ble Apex Court in W.P.(Civil) No.864 of 2022 etc., batch, dated 09.07.2024 by granting liberty to the petitioners to challenge the vires of the provisions of the State Act. https://www.mhc.tn.gov.in/judis

3. In the same line, the present Writ Petition is also disposed of, granting liberty to the petitioner to challenge the vires of the State enactment, Rules and Regulations pertaining to the levy of border tax / authorization fee.
It is made clear that insofar as the tax already, if any, recovered, the same shall be subject to the final outcome of the writ petition that may be filed by the petitioner. No costs.
