Mr.K.Balu, learned counsel for the petitioner contended that bogus death certificate was created as against the person, who was died in the year 1958. The bogus death certificate was created indicating that one Munusamy was died on 21.03.1957. Based on the said bogus death certificate, a gift deed was executed in the year 1957. Writ petitions were filed to cancel the said gift deed on the ground that it was obtained through bogus death certificate and the same were dismissed and disposed of by this Court. Similarly, the bogus death certificate used for settlement deed and a patta was also created in favour of one Velu, which came into existence through a invalid settlement document. 3.Learned counsel for the petitioner further contended that the District Collector has also enquired in this regard and set aside the bogus certificate which was created by the said Velu. The findings rendered by the District Collector that the death certificate is not a genuine one itself contemplates a criminal offence. Accordingly prays for allowing this Revision. 4.The petitioner has filed as many writ petitions in W.P.No.28745 of 2022, W.P.No.29001 of 2022 and W.P.No.17312 of 2020 on behalf of the https://www.mhc.tn.gov.in/judis CRL RC No. 2218 of 2024 __________ Page3 of 4 parties. All the above writ petitions came to be dismissed on the ground that all the transactions show that the dispute is civil in nature and there only exists a civil dispute and there is no criminal offence is made out as contemplated. 5.It is a clear case of a civil dispute between the petitioner and his relatives, which has been given a criminal colour.
