S. No. 30 Regular list HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S)/486/2024 CM/4261/2025 Ali Mohammad Zargar Aged 73 years (approx.) S/o Ghulam Nabi Zargar R/o Duroo Tehsil Tangmarg District Baramulla. Appellant(s)/Petitioner(s) Through: None. Vs. 1. Minga Sherpa (IAS) Deputy Commissioner Baramulla 2. Syed Altaf Hussain Musvi Sub-Divisional Magistrate Gulmarg at Tangmarg Dist. Baramulla 3. Javid Ahmad Sheikh Tehsildar Tangmarg Dist. Baramulla 4. Executive Engineer Flood and Irrigation Division Tangmarg, Kashmir, District Baramulla. ...Respondent(s) Through: Mr. Hakim Aman Ali, Dy. AG. CORAM: HON’BLE MR. JUSTICE MA CHOWDHARY, JUDGE ORDER 20.04.2026 1. Petitioner through the medium of this petition has sought initiation of contempt proceedings for non-compliance of the order dated 11.03.2025 passed by this court in WP(C) No. 2431/2023, by which the petition had been disposed of directing the official respondents to remove the encroachment for the irrigation Khul (Canyon) land and restore the same to its original position in accordance with law. 2. The learned counsel for the respondents had stated on the last date of hearing that in compliance to the order dated 11.03.2024, the concerned official had taken necessary measures and restored the Canyon to its original position, thereby complying with the order in its letter and spirit. 3. Upon such submission, learned counsel for the petitioner had been directed to report instructions. Today neither there is any representation on behalf of the petitioner nor any instructions had been reported, which suggests that the order sought to be enforced had already been complied with and the matter is thus settled. 4. Accordingly, the petition is disposed of as settled. 5. The petitioner, however, shall be at liberty to move afresh in case the cause survives. ; (MA CHOWDHARY) JUDGE SRINAGAR 20.04.2026 “Hilal”
