The petitioner executed a registered Settlement Deed dated 08.11.2018, registered as Document No. 2263 of 2018, in favour of the third respondent in respect of the subject property. Subsequently, the petitioner filed an application before the second respondent seeking cancellation of the said Settlement Deed. By the impugned order dated 17.06.2022, the second respondent dismissed the said application. By order dated 15.03.2024, the first respondent confirmed the order passed by the second respondent. Challenging the aforesaid orders, the present Writ Petition has been filed. 3.The learned counsel appearing for the petitioner further submitted that, having regard to the relationship between the parties and the statutory obligation cast upon children to maintain their aged parents, this Court may issue appropriate directions directing the third respondent to pay reasonable monthly maintenance to the petitioner. 4.This Court has carefully considered the submissions made on either side and perused the materials available on record. 5.Considering the advanced age of the petitioner and the statutory obligation cast upon children to maintain their parents under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, this Court deems it appropriate to direct the third respondent to pay a sum of 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.29773 of 2024 Rs.6,000/- (Rupees Six Thousand only) per month towards the maintenance of the petitioner. The said amount shall be paid on or before the 7th day of every English calendar month. In the event of any default in payment of the monthly maintenance, it is open to the petitioner to work out her remedy before the competent authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, including seeking enforcement of the maintenance, in the manner known to law. 6.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
