Instant I.A. is filed seeking restoration of the writ petition dismissed by order dated 24th June, 2019. 3. The writ petition was dismissed for non-prosecution. 4. Mr. Mishra, learned counsel for the petitioner submits that due to communication lapses between the petitioner and the engaged counsel by then, the former could not approach the Court in time and, therefore, the delay which is required to be condoned in the interest of justice. 5. Perused the objection filed by the opposite parties. 6. Recorded the submission of Mr. Panda, learned ASC for the State. p. 2 7. Notwithstanding the delay which has taken place but considering the fact that the petitioner had filed the CMAPL seeking recall of the dismissal order in the writ petition challenging the decision in 2011, this Court for a decision on merit therein is inclined to condone the default. 8. Accordingly, the I.A. is allowed with the delay being condoned. Upon such condonation, the Court is further inclined to allow the CMAPL for restoration of the writ petition, which is hereby ordered. 9. Consequently, the CMAPL is disposed of. (R.K.
