No. 335 of 2024 __________ Page2 of 4 ORDER The present Arbitration Original Petition has been filed to set aside the in entirety the Award dated 07.03.2024 passed by the Learned Arbitrators in respect of the disputes under the Contract Agreement No.25 of 2015 dated 12.08.2015 and set aside the order dated 17.04.2024 passed by the Learned Arbitrators under Section 33 of the Arbitration and conciliation act, 1996. 2. Heard both sides. 3. A Memo of Settlement had been filed, indicating that the parties have settled their disputes and that the respondent also acknowledges the payment of the agreed dues by the petitioner. It is also to be noted that the petitioner, pursuant to the interim orders passed by this Court in the instant original petition, had deposited a sum of Rs.28,60,82,993/- (Rupees Twenty Eight Crore Sixty Lakhs Eighty Two Thousand Nine Hundred and Ninety Three only) which had been kept in an interest-bearing account and the respondent has also agreed that the petitioner could be permitted to withdraw the said amount. 4. As a corollary, the Registrar General, High Court, Madras, is directed to withdraw the deposit kept pursuant to the directions issued by the Hon’ble Supreme Court in Civil Appeal No.12097 of 2024 dated 24.10.2024 together with interest accrued thereon, on a memo being filed by the petitioner, without reference to the respondents.
