The respondent filed the writ petition, challenging the charge sheet dated 28.10.2021. Article of charge against the respondent is that she did not submit genuine caste certificate at the time of procuring her job in the Bank and also failed to produce the same even after a lapse of four years in as much as she made false plea to buy time and tried to justify her position by giving one or other reason for the delay. A criminal case has been registered against her. For the past about 11 years, the respondent is in service but failed to produce the genuine caste certificate. Under these circumstances, keeping the disciplinary proceedings in abeyance would undoubtedly cause prejudice to the interest of the parties. 2.
Writ against the charge memo normally is not entertainable and in the present case, keeping the findings of the Enquiry Officer in a sealed cover is unnecessary and would do no service to the cause of justice. Thus, the petitioner/appellant is permitted to unseal the cover containing the Enquiry Report submitted by the Enquiry Officer in the domestic enquiry conduction in https://www.mhc.tn.gov.in/judis
