For Petitioner : Mr.C.Senthil Murugan For Respondents 1 to 3 : Mr.R.Ramasamy Counsel for the State of Tamil Nadu For Respondent No.4 : Mr.M.M.Iqbal O R D E R The present Writ Petition has been filed challenging the impugned order dated 13.04.2023 passed by the second respondent vide proceedings e.f.vz;.1081/2023/m2 and its consequential confirmation order dated 12.07.2023 passed by the first respondent in br.K.e.f.vz;. 1258/m1/2023. 2.Learned Counsel for the petitioner submits that the fourth respondent is the adopted son of the petitioner and the petitioner executed a settlement deed in favour of the fourth respondent. Thereafter, the petitioner made a complaint before the second respondent as against the third respondent for cancellation of the aforesaid settlement deeds and the second respondent rejected the same and also refused to grant maintenance on the ground that the petitioner is receiving pension and he ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.2998 of 2024 has income from other agricultural activities. Challenging the same, the petitioner preferred appeal before the first respondent, however, the first respondent confirmed the order of the second respondent. As against the concurrent findings, the present Writ Petition has been filed. 3.However, learned Counsel for the petitioner submits that, without going into the merits of the matter, this Court may grant liberty to the petitioner to file a civil suit before the competent Civil Court. 4.Heard the learned Counsel for the petitioner. 5.Recording the submission made by the learned Counsel for the petitioner, this Writ Petition is dismissed, giving liberty to the petitioner to to file a civil suit before the competent Civil Court. There shall be no order as to costs.
