Though notice was served and the name of 1st respondent has been printed in the cause-list, there is no appearance either in person or through counsel. Notice sent to the 2nd respondent has been returned with an endorsement “no such person” and hence, there is a deemed service. 2. This Civil Miscellaneous petition has been filed seeking to condone the delay of 203 days in filing the Civil Miscellaneous Appeal. 3. Heard the learned counsel for the petitioner and the learned counsel for the 3rd respondent and also carefully perused the records. 4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 203 days is condoned. 5. Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission. When the matter is posted for admission, the name of learned counsel for 3rd respondent shall be printed in the cause-list. 6.
