Na.Ka.No C3/ 1409 / 2018 dated 08.01.2019 on the file of the 2nd respondent, to quash the same as illegal, incompetent and without jurisdiction and further direct the 1st respondent to grant compassionate appointment to the petitioner.” 2. The petitioner's father, who was working as a Sweeper under the second respondent, died in harness on 16.12.2015. Thereafter, the petitioner's mother continued in service and retired on 31.01.2017. The petitioner, claiming that he is unemployed and belongs to an economically weaker family, applied for appointment on compassionate grounds. The petitioner's request for compassionate appointment was rejected by the second respondent by proceedings dated 08.01.2019 on the ground that https://www.mhc.tn.gov.in/judis WP No. 29761 of 2024 __________ Page3 of 5 the petitioner's mother had continued in service till her retirement and, therefore, the petitioner was not entitled to compassionate appointment. Aggrieved by the said proceedings, the petitioner has filed the present writ petition challenging the impugned order 3. Heard the learned counsel on both sides and perused the materials available on record. 4. The petitioner seeks compassionate appointment on the basis of the death of his father, late Chinaiah. He worked as a Sweeper in the respondent-Corporation and died in harness on 16.12.2015. The petitioner’s mother was also working under the 2nd respondent, and she had retired two years after the demise of her husband. After the petitioner’s mother retired, he made an application for compassionate appointment on the basis of the death of his father. Even on the date of the death of his father, the petitioner was aged 23 years. The petitioner was not entitled to claim compassionate appointment as his mother was already in the service of the 2nd respondent. It appears that it is for this reason that the petitioner had not immediately sought for compassionate appointment but waited until the superannuation of his mother. The 2nd respondent rejected the https://www.mhc.tn.gov.in/judis WP No. 29761 of 2024 __________ Page4 of 5 request as early as 08.01.2019 on the ground that he was not entitled to compassionate appointment since his mother was already in the service of the 2nd respondent. Nearly six years after the rejection, the petitioner has come forward with the present writ petition. 5. For the reasons stated supra, I see no reason to interfere with the order passed by the 2nd respondent. That apart, the petitioner has sought to challenge the same after a period of nearly six years which clearly shows that the petitioner is not in indigent circumstances as well. Accordingly, this Writ Petition is dismissed. No costs.
