Though notice has been served on the second respondent and the name of the second respondent is printed in the cause list, there is no representation for the second respondent either in person or through pleader. 5. Satisfied with the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and the delay of 260 days in preferring the above appeal is condoned. 6. Registry is directed to number the appeal, if it is otherwise in order and post it for admission in due course.
