This Writ Petition has been filed for issuance of Writ of Mandamus, directing the respondents to consider the petitioner's 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29039 of 2024 representation dated 02.08.2024 and to sanction and pay the arrears of salary, death cum retirement benefits, provident or any other benefits in pursuance of death of the petitioner's son namely John Bosco. 3. When the matter is taken up for consideration, the learned Counsel appearing for the petitioner and respondents 5 and 6, on instructions, submitted that the representation dated 02.08.2024 submitted by the petitioner had been considered by the respondents. However, the petitioner is required to submit a legal heir certificate, which had already been called for by communication dated 23.08.2024, and respondents 5 and 6 are awaiting the same. 4. It is also submitted by the learned Counsel for respondents 5 and 6, that pursuant to the earlier communication dated 23.08.2024, a reminder was also sent to the petitioner on 11.11.2024, but there has been no response from the petitioner till date, and the legal heir certificate has not been produced. He further submitted that it is only for want of the legal heir certificate that respondents 5 and 6 could not submit the proposal to the 2nd respondent herein, who would grant the terminal benefits relating to the petitioner's deceased son. 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29039 of 2024 5. At this juncture, the learned Counsel for the petitioner submits that the petitioner would take necessary steps to obtain the legal heir certificate and submit the same before respondents 5 and 6 at the earliest. 6. In the light of the above, the Writ Petition is disposed of, permitting the petitioner to obtain the legal heir certificate from the competent authority and produce the same before respondents 5 and 6. Upon receipt of the legal heir certificate, respondents 5 and 6 shall take the necessary steps to submit the necessary proposal to the 2nd respondent for the release of the terminal benefits of the petitioner's deceased son within a period of two weeks from the date of submission of the legal heir certificate. Upon receipt of such proposal, the 2nd respondent is directed to release the terminal benefits of the petitioner's deceased son, namely, Mr.John Bosco, Former Assistant Professor (English), within a period of two weeks thereafter.
