No.17314 of 2024 2.The learned counsel for the respondent raised an objection, contending that the delay has not been satisfactorily explained and that the petitioner has preferred the appeal after an inordinate delay without showing sufficient cause. 3.However, on seeing the facts that the petitioner is aged about 65 years old and the respondent is also of similar age and the suit is one for recovery of possession, this Court gives one more opportunity to the petitioner. 4.Accordingly this Court is inclined to allow the said application on payment of cost of Rs.2,500/-. Accordingly, this Petition is allowed on payment of cost of Rs.2,500/- (Rupees Two Thousand Five Hundred only) to the learned counsel for the respondent within a week from today.
