The petition is not maintainable for two reasons (1) that the petition has been filed seeking direction against the private financial institution, which is not an instrumentality of the State as defined under Article 12 of the Constitution of India; and (2) the direction as sought for by the petitioner cannot be granted and the petitioner has to approach the Debts Recovery Tribunal for appropriate relief. Accordingly, this writ petition stands dismissed. There shall be no order as to costs. Consequently, the interim applications stand closed. (SUSHRUT ARVIND DHARMADHIKARI, CJ.)
