In view of the order in ABLAPL No. 14988 of 2024 and since the petitioner is similarly situated like that of the accused, namely, Sushanta Mishra and in the meantime investigation is concluded with the chargesheet is filed without the offence under section 326 (g) BNS, 2023 being proved to have been committed by the named accused persons, this Court is inclined to extend parity to him. 2. Accordingly, it is ordered. 3. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders within a fortnight from today before the learned J.M.F.C., Basudebpur in connection with Naikanidihi P.S. Case No.0275 of 2024 corresponding to G.R. Case No.1411 of 2024, he shall be released on bail subject to him on furnishing bail bond of Rs.40,000/- (Rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not commit any further mischief involving the informant and cause any harm to the latter in any manner, whatsoever, while on bail and to cooperate the I.O. in the investigation without default. 4.
