Main Road, Pavendar Nagar, Kattupakkam, Poonamallee, Chennai – 600 056. 2. According to the petitioner, he is the absolute owner in possession and enjoyment of the said property. It is his apprehension that the respondent may, under the guise of widening the road, demolish the compound wall standing within the property, without following the procedure established by law, thereby infringing his constitutional right guaranteed under Article 300- A of the Constitution of India. 3. Learned counsel for the respondent, on instructions, submits that the apprehension entertained by the petitioner is unfounded and that, as on date, there is no proposal for widening the road. https://www.mhc.tn.gov.in/judis W.P.No.22203 of 2024 Page Nos.3/4 4. Be that as it may, if, at any point of time, the respondent proposes to acquire any portion of the petitioner’s property or remove the existing compound wall for the purpose of road widening, the same shall be undertaken only by following the due process of law. Any deprivation of the petitioner’s property otherwise than by authority of law would be contrary to Article 300-A of the Constitution of India. 5. Recording the aforesaid submission and clarification, the writ petition is disposed of with a direction that the respondent shall not demolish the compound wall standing in the petitioner’s property except by following the due process of law.
