BEFORE THE NATIONAL LOK ADALAT Yash Pal Singh vs. Om Dev Basudeva

The matter has been referred for determination to the National Lok Adalat.
Both the learned counsels appearing for the parties before the National Lok Adalat today have stated that they have been authorized/instructed by respective parties to compromise the matter before the Bench of National Lok Adalat.
As per the settlement arrived at between the parties, a sum of Rs.3,50,000/- (Three Lacs Fifty Thousand Only) was ordered to be paid as compensation to the complainant out of total fine amount of Rs.4,00,000/- (Four Lacs).
It has been stated by learned counsel for the parties that a sum of Rs.3,30,000/- (Three Lacs Thirty Thousand Only) has been deposited before the Registry of Hon’ble High Court of H.P., and the same be
released in favour of complainant-respondent with up to date interest, if any.
Further, parties have agreed that a sum of Rs.20,000/- (Twenty Thousand Only) be also released/refunded to the complainant out of the amount of Rs.70,000/- (Seventy Thousand Only) as already deposited before the learned Trial Court with proportionate interest.
Thus, in view of the aforesaid terms and conditions of the settlement, the matter stands finally settled between the parties. The terms and conditions of the settlement as above have been explained to the parties/counsel in Hindi, which they have accepted as correct and appended their signatures in evidence of the settlement. Members have also counter signed it.
The compounding of the offence shall have an effect of acquittal. Accordingly, the petitioner- accused stands acquitted.
Since the parties have adopted cost effective and speedy disposal of the matter, before the National Lok Adalat, therefore, it is not expedient to impose any compounding fee for the settlement.
File be sent to the Registry of the Hon’ble High Court for doing the needful/consignment.
Copy of order be supplied to the parties free of costs. RO/AC
